GENERAL TERMS AND CONDITIONS

[Introduction]

These terms and conditions regulate the purchase and sale transaction of SENSIHEMP products, as well as their registration on the sensihemp.pt website.

The website is owned by Marta Rafaela Monteiro Vinhas, with tax identification number 224655418, headquartered at Avenida dos Pescadores nº219 4490-013 Aver-o-Mar, Póvoa de Varzim – Portugal

For the purposes of these Terms and Conditions, it is understood by:

“SENSIHEMP” – the legal person that sells the products on the sensihemp.pt website

“User” – the natural person, who places an order on the sesnihemp.pt website, without commercial purposes;

The use of the sensihemp.pt website and the purchase of products presupposes the User’s knowledge, understanding and acceptance of these General Terms and Conditions.

[Registration on the Website]

To place an order, register in advance by filling out the form in “my account”.

It is also possible to place your order without prior registration. However, registration allows your data to be saved for future actions, as well as giving you access to your user history.

After completing your registration you have access to your personal account and you can manage your settings, save your favorite items and track your orders.

From the moment you access your personal account, you are accepting these Terms and Conditions.

[The products]

The sensihemp.pt website is aimed at all users who wish to purchase non-commercial products.

Product photographs are for illustrative purposes only, and may show differences in color or materials. Although the images try to be as faithful as possible to the product, they may not exactly reflect some characteristic, so it is essential to consult the information of the details present in each product.

SENSIHEMP reserves the right to modify, at any time and without prior notice, the information, the product offer, prices, promotions and the terms and conditions of sale on the sensihemp.pt website.

[Place Orders on the Website]

To order at sensihemp.pt you must have an email account to register

To make your online purchase you need:

Find the product(s) you want to purchase;

Add the selected product(s) to the “Shopping Cart”;

Register the User’s personal data, which will be integrated into the SENSIHEMP database in accordance with the Privacy Policy which include the “Delivery Address”, “Billing Address”, the “Payment Method”, number of telephone and tax identification number (NIF);

Finally, review your order and confirm your order.

The User will receive an order confirmation email, with details of the payment method chosen. After payment is validated, you will receive a confirmation email.

In the customer area you will be able to obtain all the details of your purchase.

Your order will be delivered by the logistics operator to the delivery address indicated in the purchase process and with the respective detailed invoice.

By submitting the order form you are accepting these Terms and Conditions as well as the Privacy Policy

SENSIHEMP reserves the right not to accept and cancel orders already confirmed in the following areas:

The product is not available;

Payment is not made using any of the payment options available at sensihemp.pt

Payment is not confirmed;

Billing, contact, or shipping information is not correct or verifiable;

There is a price quotation error;

Delivery is not possible.

[Prices]

The prices of the products presented on the sensihemp.pt website include the Value Added Tax (VAT) and the same will be described in the invoice sent to the User.

Prices are all quoted in euros (€). Customs costs related to the country of delivery of the order will be borne by the customer.

The prices of the products presented on the website are subject to change. SENSIHEMP reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.

If there is an error in the price of the requested products, SENSIHEMP or the user may, until the order is shipped, cancel the order.

The total price specified at checkout includes taxes from the country of origin (Portugal) and shipping costs (where applicable).

The User must pay only the amount specified in the order confirmation.

All orders are processed in euros (€). If your bank account is in another currency, the exchange rate applied for debiting your bank account will be automatically determined by the bank/paypal and not by SENSIHEMP​​​​​​

[Payment methods]

The User may pay for their purchases through the payment generator Paypal, MBway, Multibanco Reference and Credit Card and bank transfer

SENSIHEMP does not accept any other payment method besides those mentioned in the previous point. The User must not attempt to pay by any means of payment other than those described above, if he does so, we cannot be held liable for any damages that may arise.

[Shipping costs]

Shipping costs are quoted according to the destination and some characteristics of the order:

Shipping charges will be presented to you as soon as you enter your address and according to the total calculation of the products you intend to purchase.

We ship all over the world.

[Delivery]

SENSIHEMP ships the product(s) ordered by the User from Monday to Friday and is dispatched 24 working hours after order confirmation.

There is no possibility to schedule the delivery of our products, requiring someone on site on the day of delivery to ensure that it is delivered successfully.

If during the course of your order we find any unavailability of the product, SENSIHEMP will inform the User as soon as the unavailability is detected, and the User may choose another product, wait for the replacement of the unavailable product or be refunded.

If the carrier finds it impossible to complete the delivery on the indicated date, it will try to make a 2nd delivery. In cases where delivery is not possible, the carrier will leave the order in a parcel shop so that the Customer can collect it within 6 days, under penalty of being returned to SENSIHEMP.

It is up to the User, at the time of delivery, to check if the packaging has any damage or signs of having been violated and if there is any sign to that effect, you should not accept the order, which will be returned. The situation must be reported via the email hello@sensihemp.pt  describing the situation and, whenever possible, attaching a photograph. SENSIHEMP will resend another order at no additional cost or cancel and refund it, depending on what the User wishes.

Delivery is considered completed as soon as the User signs the invoice sent by the carrier.

[Right of Free Resolution – Return Terms]

The User may terminate his contract up to 14 days after receiving the order provided that:

The product(s) maintain their original characteristics and without signs of use;

The product(s) are complete and with all the material that accompanies the orders, which must also be returned.

The User may exercise their right of Free Resolution, submitting the intention to return to the email:  hello@sensihemp.pt and placing the item/s to be returned in a properly sealed package for collection.

Shipping costs for returning the order in the exercise of the free right of withdrawal are up to the user.

Shipping costs allocated to the initial order will be non-refundable, except in the case of a refund justified by a defect or non-conformity of the products shipped.

SENSIHEMP proceeds to reimbursement after receipt of the products and confirmation of the proper state of conservation, which, when intact, results in the reimbursement of the amount paid for the order, within a maximum period of 10 days.

If the returned items show signs of use, SENSIHEMP reserves the right not to accept the return and refuse to refund them.

[Cancellation and Returns]

You can cancel your order, as long as you request it via the email hello@sensihemp.pt before shipping.

Orders canceled before shipping are refundable for both the value of the order and the shipping costs allocated to it once the shipment is not completed.

Orders canceled after dispatch are subject to the conditions in point 10 of the Right of Free Resolution.

SENSIHEMP does not support shipping costs for product exchanges that may arise from the customer’s responsibility. Defective products or products that do not conform to the order do not generate any shipping costs for the User.

The User, upon improperly receiving a SENSIHEMP product, which is defective or other non-conformity, may choose to replace the product or terminate the contract.

As soon as the User notices a defect or other non-compliance, he/she must communicate via the email hello@sensihemp.pt describing the defect or non-compliance of the product and, whenever possible, attaching supporting images.

Upon receipt of the e-mail, we will contact the User to proceed with the replacement of the product or termination of the contract.

[Quality]

SENSIHEMP does not sell second-hand products, with defects or with raw materials different from those described in the details of each product.

Although SENSIHEMP tries to be as faithful as possible in the illustration of its products, the images may vary in color and texture depending on the monitors in question. As such, we always advise you to consult the details of each product. Any extra information that needs clarification, you can contact us via the email hello@sensihemp.pt  so that we can help you.

NOTE:

HEMPER articles are dyed with natural dyes
In addition to taking care of the environment, it is a way of expressing creativity and connecting with nature.
The results are never exact and one product is never identical to another, because depending on the type of water used or the time of year in which the material chosen for dyeing was harvested, this can affect the final result.
Each product has its own story and is unique.

[Claims]

SENSIHEMP truly cares about its customers’ feedback. As such, any complaint/suggestion for improvement/need for support that you may need, let us know via the email hello@sensihemp.pt and we undertake to contact you within a maximum period of 5 working days after receiving the e-mail. mail.

[Warranty and After-Sales Service]

SENSIHEMP products benefit from the guarantee provided for in the legislation applicable to the sale of consumer goods.

[Exclusion and Limitation of Liability]

SENSIHEMP does not guarantee the uninterrupted operation of the website www.sensihemp.pt , or any of its features, and it may be suspended for maintenance, repair or updates.

Likewise, SENSIHEMP will not assume any responsibility for any damages arising, directly or indirectly, from situations of force majeure that prevent SENSIHEMP, in any way, from fulfilling its obligations, namely, strikes, failures in the electrical network, in telecommunications services or any other services, fires, floods, inability to obtain products, materials or services, breakdowns, delays from suppliers or carriers and changes in legislation or administrative regulations.

SENSIHEMP is not responsible for any abusive use of the User’s access data to the website by third parties, as they are personal and non-transferable – it protects them.

[Modification of Terms and Conditions]

SENSIHEMP reserves the right to change, at any time, these General Terms and Conditions, you should regularly consult them in this area, using the website www.sensihemp.pt assumes your acceptance.

[Processing of Personal Data]

Carefully read our Privacy Policy and become aware of the rules and procedures we adopt to protect your personal data when you browse our website, as well as the security and confidentiality measures.

[Evidence and File]

Computer records are securely archived so that they can serve as proof of communications, orders and payments that occur between SENSIHEMP and Users.
